I'll start with the Texas smokehouse that is the border issue near the Rio Grande, and it looks like Abbott just got a minor win for his ability to keep those buoys in the water... It's such a shaken soda bottle of conflicting interests and constitutional avoidance that Abbott's request last year for US help and his subsequent triggering of Article One, Sub-section 10 of the Constitution stands out as one of the only "real" moves to conform to the Constitution. Here is another lesson in US constitutional scholarship, the Oklahoma Constitution, and the general principles of political-economics. Here, we find that the court correctly cites the OK Constitution, which actually does prohibit "sectarian control" of public schools and does make the logical tie between the state funding of religious charter schools and the breach of that provision of the state constitution (Article 1, Section 5) Public schools (oscn.net), but the court incorrectly cites the "establishment clause" of the US Const's First Amendment, which allows everyone to remember that great lesson of the First Amendment, that it only prohibits Congress from establishing a religion. The political-economics portion of it, is, of course, that any time the government gets involved, it is coercively forcing (to be redundant) people to pay, so it opens that classic Tragedy of the Commons, getting the taxpayers bickering (justifiably so) over how their stolen money will be used. As a Catholic school, one would hope that the people running it would see beyond the "we imagine that, on balance, we only are getting back the amount of money that the parents involved with our school were forced to pay into the tax trough," and look at the deeper ethics of it all. Who knows whether the money handed to the school levels the scales of money the parents were forced to pay? The point is that the system itself is immoral and unethical. The SCOTUS decision in Loper-Bright v Raimondo! (Not everyone loves RAYMOND-O...) The majority here did something positive, but, of course, neglected their oath to protect and defend the US Constitution, which does not allow the feds to "regulate" and make demands of fisherman. In fact, the Third Amendment, if taken to apply to all agents of government, would prohibit the government from telling fishermen they have to "quarter" the "Fish Counters" on their boats! Literally, the fishermen have had to house them, give them bunks, etc, and the issue in question here was the federal government within the regulatory (executive branch) expanding its demands to make fishermen PAY the SALARIES of the "Fish Counters". The takeaway from the majority decision is that they determined that the 1980's "Chevron Standard" (brought about by a challenge to an EPA rule over Chevron Oil pertaining to the "Clean Air Act") in which a "tradition" of "wide leeway" has been given to "regulatory agencies" to interpret and expand their power beyond the original statutes (based on "ambiguity" as judges claim a statute might contain). With Loper-Bright, the majority now finds that challenges to such expansions cannot be left to the judgment of the very same agency that is expanding its own power. They said that such an analysis is supposed to be brought to the courts, which will look at the ambiguous statute and determine whether or not the expansion is too broad a claim of "regulatory power."
Left unstated, of course, is the fact that the SCOTUS did not get to the heart of the matter: whether this regulatory agency (The National Marine Fisheries 'Service') is constitutional, in the first place. As people who swear oaths to protect and defend their US Constitution, they breach their oaths by not engaging in an analysis of whether the "agency" comports with any enumerated power within the document. 22-451 Loper Bright Enterprises v. This is a very interesting SCOTUS decision, and it would be great if courts applied this as a standard to other so-called "Civil Asset Forfeiture" cases where police forces engage in similar activity to what is seen here by the Securities and Exchange thugs. Here, the SEC did not afford their target with any due process or jury trial, and did not charge the man with criminal charges, but "civil" charges – trying to skirt the Bill of Rights. It really would be terrific if this were taken and applied to the insane "Civil Asset Forfeiture" aggression in which police forces have been engaged since the start of the so-called "War on Drugs", but I doubt that will be an outcome! This DailyWire piece offers another facet to the story of leftists who egregiously denied the reality of Biden's mental problems weeks ago. The pop media figures such as Scarborough and Krugman have jumped away from their previous stance that pushed the same fallacy, but they haven't apologized for trying to mislead people. Virtually anyone watching Amtrak Joe for the past year has been able to see cognitive problems, and his first Prez run appeared to function as a way to shield him from widespread public appearances, but over the last year, it's become increasingly clear that Biden has trouble expressing cogent thoughts. It’s a slightly noisy presentation, and neither Jack nor the reporters properly present the truth that Wikileaks did not release unredacted info on US forces abroad. The facts of the matter are that Wikileaks DID redact names, taking great care not to put specific US agents at risk, but The Guardian removed those redactions, which is one of the reasons there was a falling-out between the newspaper, Wikileaks, and others who supported Wikileaks’ work. The video is valuable in its power to convey the fact that Matt Miller, of the Biden State Dept., is very willing to lie, then use a fatuous claim that he cannot cite evidence of his claims because “it was before his time” in the government.
