As it was with the Bush Administration and their "war on terror" (which was whatever they wanted it to be), there is nothing in the US Constitution that allows this. Both the Hamdi and the Hamdan cases revealed that even foreigners must be afforded Habeas hearings unless Congress lifts the so-called "Privilege" of the Writ of Habeas Corpus. Additionally, the US government has no constitutional power over immigration, as we know. It would be nice if the feds acknowledged that the word doesn't appear in their US Constitution. Dave DeCamp, of AntiWar, reposted this on X, the official message to Columbia U regarding the federal demands for Colubia to continue getting fed cash. Regardless of how one feels about any international conflict that the US is subsidizing, there are key salient points to be made here. First, there's the unconstitutional handout of federal cash (our tax money), which, as in the issue from Maine mentioned above, presents the politicians great leverage over the recipients. Second, one can see that the feds literally want Columbia to put its Mid-East Studies Dept in RECEIVERSHIP. Who will control that, and how? Third, this introduces the issue of Unconstitutional Conditions. As I've mentioned for MRCTV and on Liberty Conspiracy, most SCOTUS cases have been decided in favor of the civilians and their rights when governments (any level) tell recipients of government money that they have to agree to give up some constitutionally "protected" right/rights in order to receive said government handout. The big exceptions have been the Hillsdale and Grove City college cases revolving on the feds telling them that if they got federal money they would have to comply with Title Nine. The court found that demand NOT to be an unconstitutional condition.
Given the errant decision "for national security" to uphold the TikTok ban, I wouldn't count on this SCOTUS bench ruling in favor of free speech rights.
And a campus is not public property. It should remain private. The problem is the introduction of the govt money, which creates the Tragedy of the Commons.

Again, this goes beyond Trump supporters simply noting, "Trump can do what he wants" because he handles the money. He is sworn to abide by the Constitution, and, as a result, he is not supposed to fund any agency or program that is not authorized by the "rules" of the national government.

Here, we see an area where Trump is not listening to sense, even when it is offered by Musk. His unilateral Executive Branch seizure of the Tariff power from the Congress is offensive not only in the action and not only in the tariffs. It offends in the facts that Trump will not acknowledge the inseparable tie between tariffs and higher prices (only logical, since it raises the cost of factors of production and decreases competition) and he sent Karoline Leavitt out to push the laughable canard that "foreign countries" pay the tariff tax. Even if both Trump and Leavitt try to claim that the tariff raising the price on the foreign import will see those foreign sellers get subsidized by the foreign government to help them, all that does is create a situation whereby the US is gouging people through tariffs, the foreign governments harm their own people for the subsidy cash to hand it to the companies Trump is citing, and the consumer doesn't do any better. If the overall tariff concept is such a good idea, why not increase the amount of work it takes to make EVERYTHING? Why not remove the left foot of every worker currently employed, or the left hand? That would make it harder for them to get done what they previously had, will require more people or hours of work to finish the jobs or produce the prior normal level of output, and will increase expenses, making it harder for consumers to buy what they want and save money that could be invested in other, start-up businesses. Trump plans to use the Alien Enemies Act of 1798, to hunt migrants. The act claims federal power over immigration, claims for the President an unconstitutional power to use federal troops against foreigners on state soil, and to do so without any Declaration of War or issuance of Marque and Reprisal. These are very basic and very troubling facts. They stand as reasons for Jefferson and Madison to stand against the Alien Enemies act during the John Adams Administration when Jefferson wrote Kentucky Resolution Four and Madison wrote the Virgina Resolves. The problem at that time stemmed from Adams and the eastern industrialist/mercantilist interests favoring England (mostly for financial, mercantilist reasons) in the war between England and France. Jefferson continued to appreciate the French help during the American Revolution, and he did not appreciate attempts to erect trade barriers against French goods. In response, not only did Adams and his allies in Congress pass the Sedition Act, making it illegal to protest Adams or speak against his policies, they passed the Alien Acts, which Jefferson and Madison protested in the documents mentioned. This echo of that Adams criminality is a Trump move to lasso the still-extant, still-offensive 18th Century statute. It's as bad now as it was then. LINK!

The appropriate method (under the Constitution) to handle this is for the state legislature or governor to ask for federal help according to Article Four, Section Four (as Abbot has done in TX, two years ago), or, if the Congress wants to chase members of these groups back in Venezuela, they can issue Letters of Marque and reprisal to let the Chief Exec hire mercenaries. One wonders what the govt of Venezuela would do if the US wanted to send soldiers or mercenaries into that nation to go after people the US cites as gangs. And what is "terrorism" in the eyes of the feds? Biden's DOJ tried to apply that to parents who opposed LGBTQ pedagogy at their children's school. Trump (and even RFK Jr, who was CENSORED for speaking up during the COVID insanity) now tries to use it to broadbrush peace protesters who oppose sending weapons to Israel. Not good.

Again. What portion of his US Constitution has he cited to claim the power to do any of this? Just as it was with the COVID border locks, this is patently unconstitutional. And even if it were constitutional, Mr. Trump never could apply enough makeup to it to make this police-state activity look ethical or moral. LINK!

Here's a question... In a US operating by the Constitution, wouldn't most cities be "Freedom Cities" free of these regs? How far does this idea run towards federal subsidies to corporations, to technology "investment" and other things? If the cities are "Freedom Cities" will the feds keep their hands off when it comes to freedom of association and allow people to hire "illegal" immigrants? How will property rights be handled if people outside these cities are harmed by activity that spills over?
