I got to write on Trump's order, and it blows my mind that a judge would block this. What I would love to see, on a "separation of powers" basis, is for Trump to disregard the judge's block and continue with his actions. To re-use the line from Andrew Jackson, "The court has issued its ruling... Now, let's see them try to enforce it." As a person sworn to protect and defend the Constitution, Trump is supposed to act accordingly, and his Executive Branch control of federal prisons (only those, not state prisons getting federal money) requires him, not the courts, to execute only statutes that he deems constitutional. If the Congress doesn't like it, they have it in their power to impeach him. This harkens back to, of all people, George W Bush issuing "signing statements" that said he would enforce certain portions of new statutes, but not others.
Here is the new wrinkle in this trans-prisoner face. LINK!

Check this out. After the clear, inarguable, repeated fires and increased fire risks caused by government and the energy monopoly in CA, Gavin Newsom is deflecting, putting the focus on home builders/owners. He wants to increase their expenses even as he pretends that the moves, somehow, could protect them against the tsunami of flames that swept across the LA area last month. Sometimes, political characters surprise the public by admitting wrongdoing, accepting at least a portion of blame. This guy races on, heedless of the truth. LINK!

Likewise, Trump and DOGE are shining a light on so-called "unnecessary" or wasteful positions or projects, but making an unconstitutional construct more "efficient" misses the forest for the trees. Not only does Trump swear an oath to not fund agencies - such as EPA - that don't conform to the Constitution, even if he runs into pushback, or can't eliminate them all the way after trying to do so, the attempt to do so allows for key education of many Americans, giving them the chance to know the truth, regardless of success or failure. And, on a moral level, these EPA employees have no right to my labor, regardless of their ostensible goals. LINK!

Here's another shiny prize from CA. Many people suspected that the government in CA and numerous LA politicians would attempt to grab big swathes of the burned private property in order to convert it to something akin to the "Fifteen-Minute City" model. The point here, as the Climate Cult and the "oceans are full of straws" gangs get some pushback, is that Trump's move is a Band-Aid on a deeper problem: the federal government claiming control over the oceans and over our choices of straws, or the feds claiming that they can tell us what kinds of cars we can buy. This is a breath of fresh air, as the euphemism goes, but as long as those controlling agencies and the mentality of federal control remain, the potential for even more insane bans and fascist manipulation of markets will remain. King Salman bin Abdulaziz (Saud) of Saudi Arabia ALREADY has unequivocally stated that they not only will not agree to this, but that there has been a peace plan, promoted by the Arab states, from 2002 that supports a two-state solution, delineating the line between Israel and the Palestinian homeland as the 1967-established border. Trump's push for something similar, mixed with his idea of allowing "people from all over the world" to live in his Utopian "US-Controlled and Rebuilt" Gaza not only is monumentally unconstitutional, it also assumes other nations must take refugeed from Gaza - even as he works to execute his push to purge migrants from the US. On the immigration front, we see FLA Gov DeSantis considering the move to deputize state patrol police to act as immigration officers. If he understood the wording of the Constitution, he would not have to do that, because the immigration issue in Florida is up to Floridians to handle, not the US government. Still, this is an interesting move, and many people who "identify" as conservatives will applaud the move, regardless of how it overlooks the fundamental constitutional federalism written into the document. As always Gard, you put together so much great stuff. For those who think that Trump or his Agency heads, don't have the power or the right to close agencies or gut them from their own leadership positions, I would like to remind them and the few Judges who expose themselves with their illegitimate "Cease and desist" orders or "Temporary hold" orders, that they are the ones who do not have "standing" to issue such orders from the bench. For a change, Marbury v Madison and Fairfax Divessee (aka Martin) vs Hunter's Lessee, finally turn the tables on the over 200 years of abuse by the government itself. When I say "government" I mean all three branches.
I invite people of every race, creed and color to go look them up. The decisions were posted by Justice John Marshall and Joseph Story. Both men, took their vaunted and famed opinions out of the Judiciary Act of 1789 and cleaved the Constitution's description of the Judiciary's power to make decisions and themselves, rewrote the Constitution from the bench.
In the Martin v Hunter case, Joe Story spun it around from Marbury! He maintained the SCOTUS had authority to intervene and had authority over a state supreme court as opposed to Marshall saying the court had no jurisdiction in cases that did not originate inside the government.
Why do I bring up these cases and the Constitution? I bring them forward because the judges who challenge Trump, are forgetting that in both cases, they are outside of the SCOTUS' place in all of this. The lawsuits must come from a Federal Agency or a State Court Case, not associated with Federal Government, do not fall under the purview of the Federal Justice system. It is much like the New Case against Trump's payoff behavior that was not breaking any Federal Crime and a State Prosecutor, has no power to try a case under Federal Law in State Courts. There is no "State Court Decision" to be reviewed here. Both Marshall and Story, freeze out the lower State and Federal Judges. This is why Trump pulled back one memo the other day and let the agency head, move forward with DOGE.
All of that means that in end, these judges who are trying to stop Agency heads, using the power of making policy of internal matters and protocols, can't be sued or charged with a crime, unless they are in some way, breaking the Constitution.
Not a surprise, coming from the broken public education system who turns out judges like these.
Keep up the good work sir.
The Judges need to go back to school and stay off the golf courses.
