This is a major problem: A. ethically, since it employs the power of government to promote a procedure that sees many fertilizations , i.e. human life, placed in cryo-stasis or discarded, and, B. constitutionally, since there is absolutely zero power for either the Executive Branch or Congress to subsidize, or coerce companies to pay for, this, or any other medical procedure. Here is a story that aligns with last June's Supreme Court ruling in "Loper Bright" (the fish-counter case that saw the SCOTUS tear down the Chevron Deference and tell "regulatory agencies" that they could not expand their "powers" beyond what the Congress initially prescribed - typically, unconstitutionally - in the original statute). Loper Bright also saw the SCOTUS agree with the plaintiffs that the feds were acting unconstitutionally when allowing the "regulatory agencies" to force legal challenges to their edicts into "Administrative Law Courts," essentially allowing the very regulatory agency that attacked the plaintiff to act as its own judge. The SCOTUS ruled that legal challenges to the regulations had to be heard in REAL courts. Here is the latest fold in the origami-salami, as Trump moves to remove the "administrative law judges" (a nonsense term, since judges have to work in the JUDICIAL branch) and the Biden barriers to the removal have been deemed unconstitutional by the new Justice Dept. Notice that the Justice Dept Chief of Staff doesn't even get it right when he refers to the fact that these "judges" are "not elected." That's the case with most judges. The point is that they are in the wrong branch of the federal government and are not, constitutionally speaking, real JUDGES at all! LINK!

Here is another tale of the tariff problem on its way, in the form of fertilizer prices. Like Biden's restrictions on natural gas imports hurt potash production (the process requires hydrogen - H2 - from natural gas and nitrogen - N2 - to form the ammonia for the fertilizer), Trump's tariff mania will see the Canadian supply of Potash highly taxed, which will increase costs for virtually every kind of food grown or raised in the US — from beef, poultry, and pork, to vegetables and even the price of corn-based ethanol. Of course, Bain Capital was founded by Mitt Romney, but he moved on a while ago, and former MA Gov Deval Patrick was its managing director from 2015 to 2020. This exploded online Friday, with the embedded video really making the rounds. Janet Mills is not well liked by many people in New England, let alone Maine. Given her flouting of her own dumb and unconstitutional COVID lockdown edicts, she made herself a laughingstock, and now, Trump has swung hard against her defiance of his order for states to stop putting trans guys pretending to be girls into girls' public school sports. Mills said she has to conform to laws, but Trump claimed the federal law "trumps" Maine law. It doesn't, of course. What the feds do is tie money-strings to states, threatening to withhold the unconstitutional funding unless the states conform to the pedagogy that the feds want. In a US that operated along constitutional lines, this would not be an issue. Mills is nutty here, and Trump doesn't acknowledge the truth of the unconstitutional federal funding system. And, though he has said he will "end" the Department of Ed, Trump also has said he will "get the funds to the states" in different ways, meaning he still will breach the Constitution. Constitutionally, the states and localities are supposed to handle education, and if the states are not protecting kids equally (say, by placing boys into the girls' sports, they are endangering the girls) citizens can sue on 14th Amendment grounds. Well, Meta did it. They followed Elon Musk's path and, according to them, now will use "Community Notes" rather than their "truth squads". This seems to be a smart way to avoid the tricky clause within Section 230 of the 1996 Telecommunications Act that sees the federal government provide social media and ISPs with indemnity against defamation suits and state action for what a state might define as "indecent content" as long as the social media companies and ISPs "curated" the material "in good faith." This now shifts the "curation" policing to the users, allowing a much wider scope for the term "in good faith." Here's the new development - LINK!
