Trump says he will appeal the restraining order on his Admin lifting the previous Birthright Citizenship policy. Since, of course, this has a bearing on whether the "anchor-baby" phenomenon can continue, allowing the parents of such a baby to remain, even if they are not citizens, this is a big issue when it comes to the Trump ICE deportation policy. The key jurisprudential/constitutional facet of this is the clause in the 14th Amendment that allows for "citizenship upon birth" for those born in the US, and, even more key (key-er!) is the term "under the jurisdiction thereof". People for and against "birthright citizenship" have argued about this, and, logically, this is how I see it: the clause is supposed to give exceptions to the children of diplomats and the diplomats, themselves. For example, all states in the US can arrest and prosecute foreign tourists for crimes like armed robbery, murder, etc. These tourists are "under the jurisdiction" of the statutes of the state they are visiting (assuming the crime is in the same state, of course). But, again, of course, diplomats are granted immunity in most cases. Thus, one must conclude that foreigners are under the jurisdiction of those states, and that this would apply to the above clause in the 14th A. Yet historian Tom Woods posted a very interesting item on X citing the clause and noting that the foreign visitors who give birth are NOT under the jurisdiction of the US, but under the jurisdiction of their original homes. That doesn't jibe with the fact that states can and will prosecute foreign tourists for crimes, and they may even ask for extradition if the foreigner gets back home before arrest. Here is Tom's post on it. Notice how he cites Senator Jacob Howard, who actually wrote that clause of the 14th A, yet, even that Senator's statement is confused. LINK!
My reply is linked below, and in it, I note that, while this is a fascinating debate, it actually has no bearing on anything except naturalization, which is a constitutionally granted power for Congress, while immigration is not. As you know, it's very clear that this is a state issue, so, if one were to adhere to the Constitution, even IF one could successfully argue that children born in the US to visiting foreigners are not automatically citizens, that has no bearing on the fact that the policies about them staying or being forced to leave were, and should still be, placed by the Founders in the hands of the states. (My reply is a more concise version of what I've written for MRCTV on the topic.)

And, Mr. Trump is in the news again (and many more times, of course) with this move to sack the Bidenista bureaucrat who worked with locals who were upset by their schools removing certain books from the school libraries, etc. Some observers might see this as a First Amendment issue for the schools, but localities and states are allowed by the First Amendment to censor, and the collectivist public school system cannot include everything that everyone who pays taxes might want or want removed. Each state's constitution would be the key factor on that level. When it comes to the federal bureaucracy here, it's clear that there is no provision in the Constitution allowing for this kind of federal involvement, to promote censorship or to give advice about how to prevent it on a local level. Some folks might applaud the feds trying to send more money to CA to fight wildfires. Just like US parks and other holdings of land go far beyond what the Constitution allows the feds to own and run, this assistance is unconstitutional as well. Meanwhile, the money-trouble state, itself, sees its Dem majority foundering on a state move to take care of land that is at risk of burning in wildfires. LINK!

If the SCOTUS does agree that parents can opt their kids out of this, can taxpayers opt out of having to pay for any of the school system, on principle? There are myriad facets of school pedagogy for which people might object paying, and then there is the larger principle of not having to answer to the command to pay for any of it, in the first place... The Trump halt on "foreign aid" for a 90-day "audit" brings him a bit closer to the Constitution, which doesn't allow the aid. This pause likely will see the EU try to ramp up the "aid" to Ukraine, and push Zelinsky closer to negotiations because he will lack armaments in a few weeks. But Putin is in command of this outcome, and he could decide to make the "negotiations" moot by getting to a military victory and not engaging in negotiations. The victory would be months off, but it is inevitable. Meanwhile, the government of Israel gets an exception to Trump's pause. This is a big one. Despite Tulsi Gabbard flipping on Section 702, this might show some hope for folks who actually want to uphold the US Constitution. If only the judge had widened the scope to look at all of FISA, which is entirely poisonous to the Constitution. The "incidental" spying is unconstitutional, and the initial spying (through secret "FISA Court" "warrants" that are not real, publicly visible, warrants) also is unconstitutional. The Fourth Amendment is a functional rule, not compartmentalized into exceptions for non-citizen targets. Sec 702 will expire in 2026, but it might go down sooner if this goes to the SCOTUS and they rule properly. Of course, given the insane "national security" rationale the court members just offered for the towering breach of the Bill of Rights in the form of their upholding of the TikTok ban, I wouldn't bet on the Supremes ruling in the right manner.
