The TikTok ban. Not a ban of U2's "Eleven O'Clock, Tick-Tock", but far worse. Here is the PBS coverage, with its link to the SCOTUS's unanimous and flagrantly in-your-face dismissal of the US Constitution on both the 1st Amendment and the 4th, as well as the 5th and 6th and 8th, since the company is being punished without any trial. Essentially, this is a Red Flag statute against free speech, freedom of association, and freedom to peacefully trade (which really is freedom of association). LINK!

The text of the ruling that is hyperlinked inside that PBS report indicates on p. 7 that the SCOTUS members still cling to the false notion that, essentially, Byte Dance is under the control of China, or that the probability of it becoming so is very high. Which means nothing, when it comes to the Bill of Rights and the fact that the US Constitution grants no power for Congress (or the Prez, as Trump originally wanted to ban it himself in his first term) to ban or force the sale of a company. That is SO clearly fascism it's like a slap in the face. I'll copy and paste from the generated transcript some of what I said about it on Liberty Conspiracy Friday night and you can see how my position stands up to your own fair scrutiny if you want.
Please read the bolded if you like, or skip, but hereare the nuts and bolts of the key points, starting with their main SCOTUS rationale, that so-called "national security" which is a term they can apply to virtually anything to give them a pretext to censor, ban, etc. Much like the "pandemic" argument they used to silence supposedly "dangerous, unscientific statements and social media users.
"National security? What the heck does that have to do with abridging freedom of speech? Are you at war? Are you accusing people of being spies? If so, accuse each individual, not the platform. Again, this would be like the John Adams administration claiming during the Sedition Act that they can shut down newspapers because they don't like what's going out on the newspapers, or that the newspapers might make deals with the people who are selling the papers at the time to find out what kinds of people they have buying their papers. That's a matter of contract between the buyer of the paper and the seller, for them to handle if the buyer finds it a breach of an agreement, finds it isn't what the seller claimed upon sale. He can sue for breach of contract. It's not for the federal government to prohibit them engaging in free association and commerce. And this is one of the amazing things about this Supreme Court decision, this idea of: 'Well, it doesn't impose a disproportionate burden upon their First Amendment activities.' Who the heck is the government to decide? What are the Supreme Court Justices? Some magic-on-Delphi people to decide whether it's disproportionate or proportionate?
If it is an imposition, any imposition... It's unconstitutional. It breaches the First Amendment. Congress shall write no law abridging the freedom of speech. It doesn't matter whether the government deems it proportionate or disproportionate, at or on whatever scale they want to use. That's ridiculous.
And their argument regarding national security is a nonstarter, given the words of the U.S. Constitution. The tepid, weak argument also pulls in the fear that ByteDance, and they've actually stated this, that ByteDance might allow the Chinese government to not only collect data, but to harm people with what the FEDS call misinformation — by sifting info, through their app screens, sort of like what the U.S. government tried to make sure that Facebook did to us and what Twitter did to us and what Google did to us when they put everybody like me and Eric Shiner on the Google blacklist before the Biden election in around 2017. We were on that Google blacklist, as were so many others. I'm sure David Knight was, Infowars was when he was working there at the time. So when they claim that, oh, we're worried about China collecting this data, the U.S. government's already doing it and the CIA-assisted Google, which got seed money from DARPA, also did it.
And if they're worried about ByteDance somehow influencing what we're seeing, well, then where does that stop? So think about this. They're saying that ByteDance also might try to influence data such that we only see certain types of data that could steer us in a certain direction, thought-wise. Sound familiar? Yes. They're saying AGAIN that "mal or mis-information" could harm the American populace.
So it's not just the stealing of American data, which the US government does, and they wanna do more. It's not just that worry about data, which we could decide. That's why so many people were going to an actual Chinese government app to show the feds, 'I don't care. I don't care. This is not a worry.'
This is not a national security concern. I'm not working for you and your defense department. So what are you worried about?
'Well,' they might say, 'somebody could get your economic data.'
Oh, you mean like somebody might get my social security number from hacking Blue Cross Blue Shield or the U.S. Tax Agency? How about that? Somebody might get my medical data, the way the Secretary of Health and Human Services can do that at any time without a warrant. Somebody might, oh, get a secret warrant on me through Section 702 of FISA. All these black marks are already established practices of the United States government, and they're telling us 'We government-types are really worried. We're really worried for you.'
Oh, thank you for caring so much. What are you talking about? That's like a spouse abuser saying, 'I'm really worried that that other person might hit you. So I'm gonna continue to hit you so he doesn't hit you. You see, I've got a new thing.
I'm gonna use another fist and hit you in another way. And I'm gonna hurt you over here with your free speech. I'm not going to allow you to even consider the fact that I've trapped you in an absolute echo chamber of statist rhetoric.'
And the thing about it is, if they're going to do that and they're going to say, 'Well, China could influence ByteDance and then ByteDance could influence what you see, so it could be detrimental to you, and many others. The product that you get, could harm American people. So we've got to stop it for national security...'
Well, where does that end?
Can the feds say, 'Well, you know, that knife seller is selling something that could harm someone else. Someone could use it against another person. So we're going to have to step in and stop that. This is the equivalent of the mindset that tries to tell people they can't get a firearm for self-defense. It's a Red Flag statute against freedom of speech and association.
We should be able to assess our peaceful use of something that we sign up for and doesn't directly bring harm to another person with our intent. Period. How about that? How about you leave us alone? And by engaging in your block, now you, the government is the aggressive one.
You are the one who is telling us, as a matter of federal taxation and bureaucracy, 'You're going to pay for your own censorship. That's what they just said in the Court. And we had to pay the Supreme Court members to come up with this decision, as well. So, on every front, they're using our money to silence us. And then they're using our money to say, it's okay to silence us.
'In our black robes, we've decided.'
I don't see any way out of this, any glimmer of saying I had a choice in any of this. Do you? Yep. That's what it feels like to be a slave, said Roy Batty."
Hopefully the scholarship and logic match it in intensity.
The other aspect of this that I discussed has to do with the oath the President takes, which is that he will protect and defend the Constitution. Trump has indicated a change of heart - slightly - whereby he wants to find a 'domestic' buyer. (More fascism, a sale through force of govt). People say he can't issue an Executive Order to stop the ban. He doesn't have to issue an Executive Order to stop the ban. As a man who swore to abide by the document, he is obligated to say, "There is no such power in the Constitution, and I will not enforce such a statute." He's getting closer, but his advisors and he seem oblivious of the key foundation of it all. Link. This fire is a reflection of the backwards thinking pushed by Newsom when it comes to PG&E, the push to make all new homes have 50% of their power coming from solar (which produces the power in the daytime when people are away, and they don't use it, so the corporation bleeds it away and sends it to these batteries or to other states because PG&E doesn't have the capacity to store the unused power produced during the day. Talk about shifty. This appears to be an attempt to muddy the clear reality that the "Amendment" never was passed. Similar to Obama, Trump, and Biden treating the "Paris Climate Accord" as if it's a ratified treaty, when it is not, this pushes the idea into younger people's minds, to let it fester, like O'Brien continually holding four fingers in front of Winston Smith in "Nineteen Eighty-Four" and telling him it's five.
