We open with one of the most lie-packed-in-short-form statements of the week.

BUT, WHAT OTHER DETAILS CAN WE UNCOVER? The Constitution placed “all Cases of admiralty and maritime Jurisdiction” in the federal judicial power and gave Congress authority to “make Rules concerning Captures on Land and Water.” The Judiciary Act of 1789 gave the new district courts exclusive original jurisdiction in admiralty, including prize. In Glass v. The Sloop Betsey (1794) the Supreme Court confirmed that every district court possessed the full powers of an admiralty court “whether considered as an instance, or as a prize court.” The keys here are three-fold. First and second: without a Declaration of War, the only “captures at sea” that the US can conduct have to stem from mercenaries hired under Letters of Marque and Reprisal). Third: If any non-war action is taken, the BILL OF RIGHTS must apply. The US cannot simply hire mercenaries who, upon going after baddies as characterized by the feds, capture the baddies but then do not deliver them to US courts where Due Process is afforded. That would allow the Congress to circumvent Due Process anytime they wanted simply by issuing Letters of Marque and Reprisal against any civilians…
Historically, Congress repeatedly authorized privateers (letters of marque) and prize money for naval crews. Captors filed a “libel” in district court; the court applied prize law to decide whether the capture was lawful, whether the property was enemy or contraband, and how proceeds would be divided. That system was used during the Quasi-War with France and, far more extensively, the War of 1812. The Prize Act of 1812 is one of the key early statutes. (I suspect you detect the fuzziness of their actions and how it’s easy for the feds to claim they don’t have to afford Due Process when they really DO have to afford it, including trial by jury.) AND IT GOT WORSE…
The Civil War produced the largest body of American prize litigation and the most important Supreme Court decision on the subject. Lincoln proclaimed a blockade of Southern ports in April 1861, before Congress had formally ratified his actions. Union warships seized blockade runners and other vessels; district courts condemned them as prizes.Four of those early seizures—The Brig Amy Warwick, The Schooner Crenshaw, The Barque Hiawatha, and The Schooner Brilliante—reached the Supreme Court as The Prize Cases (1863). In a 5–4 decision written by Justice Robert Grier, the Court held that a state of war existed as a matter of fact after the firing on Fort Sumter, that the President as commander-in-chief could institute a blockade without waiting for a congressional declaration of war, and that captures made under that blockade were lawful prizes. The Court treated the conflict as both an insurrection and a war to which the international law of prize applied. - That is, of course, insane. Unless Congress Declares War, the US government is not at War. It’s pretty simple. But, even then, one can see how the judges cared not for the wording of their “rule book”.
