The SCOTUS "Cargill" ruling. As I got to mention on my show Friday, Clarence Thomas wrote the majority decision, which focused on two irrelevant matters when it comes to the Second Amendment, but that was expected, given the limited room for arguments of Michael Cargill and his legal team. Mr. Cargill owns a gun store in TX, and, as Thomas notes on page 5 of the decision, "...Cargill surrendered two bump stocks to ATF under protest. He then filed suit to challenge the final Rule, asserting a claim under the Administrative Procedure Act. As relevant, Cargill alleged that ATF lacked statutory authority to promulgate the final Rule because bump stocks are not “machinegun[s]” as defined in §5845(b). After a bench trial, the District Court entered judgment for ATF. The court concluded that 'a bump stock fits the statutory definition of a ‘machinegun.’”
So, first, there is the question of how President Trump's "Bump Stock Ban" executive order of 2018

The Trump administration bans the high-power gun attachments of the type used in last year's Las Vegas shooting massacre of 58 people, giving the owners of "bump stocks" 90 days to turn in or destroy the devices and blocking owners from being able to register them.

...and the "how many devilish angels can dance on the head of a poison pin" sees the SCOTUS pondering whether the ATF under Trump or any subsequent Prezzz can "interpret" it's "Congressional sanction" as the so-called "Chevron Standard" allows, "within reasonable parameters" of the original legislation that either created the agency or under which the agency is trying to expand its purview. The old standard also is being challenged by northeastern fishermen since the feds are trying to make them not only keep "fish counters" on their boats, but also to make the fishermen PAY their fed-agent salaries.

The Supreme Court will soon decide whether to overturn a 40-year-old decision that is come to be known as the Chevron Deference.

Then, within that question of "can the Prez do this through Exec Order, via ATF" and the Chevron deference tradition, there's the question of how malleable the 1934 "Firearms Act" is, and whether a "bump-stock" turns a single-pull-single-round gun into a machine gun that would then be covered by the act. All of the debate about whether this is the case (it isn't, because the 1934 statute clearly states that a "machinegun" as they call it fires multiple rounds for one pull of the trigger, which is not what happens to a single-shot rifle when a bump-stock is attached. The stock simply uses recoil to push the trigger back against the finger and allow for a quicker second, third, fourth, etc, trigger-movement. But none of that is pertinent to the right to the heart of the matter, which is whether any agency of any level of government, be it done through legislation or via "Executive Order" can INFRINGE on the right to keep and bear arms or any device that might help make a firearm work. The answer in the Second Amendment is a clear NEGATIVE! And that implies the very existence of the ATF and the 1934 Firearms Act, which infringes on the right by telling people they must pay a high tax on certain guns (and on silencers). Thomas didn't address this at all.
And on a similar vein, even if the Constitution were amended to allow the existence of the ATF or "gun-grab" statutes, there would be no moral authority for the Constitution in the first place. I never signed it, and it is imposed on people. It would be nice if the politicians came CLOSE to their oaths to uphold it, since they are claiming power over us that they cannot claim in any ethical capacity, but, clearly, even Justices like Clarence Thomas are unwilling to back it up. The SCOTUS's ruling on the FDA allowing Mifepristone to be sold via mail and in drugstores... The Justices were unanimous that the doctors bringing suit did not have standing. The doctors claimed that, though they were not being forced to administer the drug or give women prescriptions for the pills, they might have to deal with women suffering the negative consequences of their chemically-inspired abortion or have to receive women as emergency patients as they were experiencing the evacuation of the dead fetus from their womb. The plaintiffs argued that this would run counter to their own religious beliefs standing in opposition of abortion. But the entire bench at the SCOTUS ruled against them. What really gets me is the way the news outlets cite the FDA as claiming that the drug is "safe and effective". It is the nature of the drug that if it is "effective" it is killing a human being, so how can it be termed "safe"? That kind of fatuous avoidance of reality runs deep in the abortionist mindset, only looking at the woman, not the life being taken. Here is CBS on it:

The case still has legs, in a way, because three states are suing to block the sale in them. Technically, the sale of it is not a criminal act, just like the sale of gasoline isn't aggressive, but if someone pours it on another person and lights him on fire, that's a criminal act. These state AGs claim that the drug kills – which it does – and that they have statutes that prohibit many kinds of abortion. As I often note, the Fourteenth Amendment mandates that any state with a statute punishing a killer for taking a life must equally "protect" all human beings, so the 14th Amendment would act as a national ban on abortion because all states DO have statutes punishing people for taking human life.

A new federal court ruling has found in favor of states attempting to stop the application of Title Nine to "trans" people. The court has not addressed the unconstitutional nature of Title Nine or the precursor to it, the "public accommodations" section of the 1964 Civil Rights Act that destroyed the concept of private property. In this case, the states were fighting for state freedom from the new "Biden expansion of Title Nine" to trans people, but they did NOT question Title Nine at all. One can dream. Perhaps I can identify as a person who lives in a US that operates KINDA closer to the Constitution? It's not real. It's a fantasy, but...
